Slash Discounts Platform Registration Terms and Conditions

INTRODUCTION

These Terms & Conditions govern your use of the SLASH Application Platform, your SLASH App, SLASH platform ID and Slash Merchant APP.

THE SLASH APP COMPANY LIMITED, a limited liability company incorporated and existing under the laws of Thailand, company registration number 0845557002271, having its registered office at 26/16, Moo.4, Bophut. Sub-District, Koh Samui District, Surat Thani Province, Thailand by Mr. Jamie Alec Sinclair. Company’s director.

“You” are the person who has registered to use the SLASH platform. Where you are a third party registering for the SLASH platform on behalf of another individual, you confirm that you have brought these Terms and Conditions to the attention of that other individual and that the other individual has accepted these Terms and Conditions. 2. DEFINITIONS

In these Terms and Conditions:

"Agreement" means the agreement between us based on these Terms and Conditions.

“Merchant” means a business organization offering to give a saving or promotional terms to you if you make a purchase of product or services using your SLASH platform identification.

“SLASH App” means the personal mobile device application made available to everybody above the age of 20 years who wish to use the SLASH platform with Thailand.

“SLASH platform” means the services provided by The Slash App Co ., Ltd under the SLASH brand, the supply of the SLASH App, the SLASH platform ID and the associated on-line identification on the SLASH website

“SLASH APP” means the free-to-use version of the SLASH APP platform;

3. AGREEMENT

When you sign up to use the SLASH platform, you are entering into a legally binding agreement with us. These Terms and Conditions set out that agreement. We therefore recommend that you read these Terms and Conditions.

You must accept these Terms and Conditions to complete your SLASH platform registration, download the SLASH App via QR Scan Downloads both the User End and Merchant end, receive your SLASH platform ID. You must also comply with our SLASH website terms and conditions, a copy of which can be found here: www.theslashapp.com/terms-of-service.

All products containing Personal Identifiable Information or PII, any data that can be used to clearly identify an individual like name, surname, photo, and other, are treated as personalized products and therefore are non-refundable. You have the right to deactivate/delete your SLASH membership at any time unless under a Merchant Agreement Contract. Details of how to request account deletion can be found on our FAQ on our welcome email.

4. YOUR COMMITMENTS TO US

You represent and warrant to us as follows:

You are a Tourist or Resident at the time of completing your SLASH platform registration.

You are at least Twenty (20) years of age or above at the time you complete the SLASH platform registration.

Note that you do not need to be staying in Thailand to register for the SLASH platform, if you are, in fact, over 20 years of age.

You represent and warrant to us that you have completed all the information given to us during the registration process truthfully and accurately; and

any supporting documentation you have supplied is accurate; and

you will not permit anyone else to use your SLASH APP ID or login details to seek a discount or promotions offered by a Merchant or for any other reason.

We may cancel your SLASH platform registration, revoke your SLASH platform ID, if any of the above warranties are not respected or fulfilled.

5. USE OF THE SLASH DISCOUNTS PLATFORM

To use the SLASH platform, you must download the SLASH App Via our QR Scans.

You must then complete all steps in the registration process, including the submission of Name, D.O.B Country Of Origin, Gender, Nationality and how you are traveling being solo, couple, group or Family and contact details before you can enjoy the benefits of the SLASH platform. Following successful completion of your registration for the SLASH platform, you will receive your welcome email and user ID. You agree that your use of the SLASH App, SLASH platform ID, in accordance with these Terms and Conditions. The SLASH card and SLASH platform ID are personal and not transferable.

The SLASH platform allows you to obtain access to discounts or promotions offered by Merchants from time to time. You obtain a discount or promotion by presenting the SLASH APP at the establishment on your mobile device to a Merchant member or staff, at the point of ordering the relevant goods or services from the Merchant.

We may receive payment from the Merchants for including them on the SLASH platform. The payment is not dependent on your individual purchases from that Merchant. You can see a list of some of the discounts and promotions of Merchants on our website at any time here. While we use our reasonable efforts to keep that website up to date, we do not guarantee to do so, since those discounts and promotions may be varied by Merchants without notice at any time.

We endeavor to ensure that every Merchant accepts the SLASH platform ID on your mobile device, but do not guarantee that this will always be the case. Where we know that a

Merchant does not accept the SLASH App, we will use reasonable endeavors to indicate that this is the case on our website here.

We are not responsible for the provision of any goods, discount, benefit, or other service by a Merchant.

We are not a guarantor of nor are we responsible in any way for (i) the provision of any goods or services by a Merchant or any other third party or (ii) anything arising out of the provision of those goods or services.

The SLASH APP or SLASH platform ID is not a proof-of-age.

6. SLASH APP

We grant you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the SLASH App to make use of the SLASH platform. The SLASH App may only be used for identifying Merchants and presenting your SLASH APP to a Merchant to obtain the offered discount or promotion.

This license is subject to the following conditions: (a) your use of the App is solely for your personal, non-commercial use; (b) you will not duplicate, transfer, give access to, copy, or distribute any part of the App in any medium without The Slash App prior written authorization; (c) you will not attempt to reverse engineer, alter, or modify any part of the App; and (iv) you will otherwise comply with the terms and conditions of these Terms and Conditions.

You acknowledge that your agreement with your mobile network provider (“Mobile Provider”) will apply to your use of the App, and you may be charged by the Mobile Provider for data services while using the App, accepting responsibility for such charges. If you are not the bill payer for the device being used to access the App, you will be assumed to have received permission from the bill payer for using the App.

We will use reasonable endeavors to always make the App available to you, but we cannot guarantee an uninterrupted or fault-free service.

We reserve the right to make changes to the App from time to time, including, without limitation, the removal, modification, and/or variation of any elements, features, and functionalities of the App.

7. SLASH PLATFORM FEE

The fee to register for the use of the SLASH platform is indicated when you complete the SLASH platform registration but is actually FREE for everybody.

8. DURATION OF YOUR SLASH PLATFORM USE

Your use of the SLASH platform pursuant to these Terms and Conditions is valid for the term of your registration.

For SLASH Merchants and Users, this is an initial twelve (12) month term from the date of completion of your registration; and this term can be extended by additional 12-month periods if you are still eligible for the SLASH platform.

Once your SLASH Plus membership has expired after 12 months, you will need to renew again for another 12 months.

9. CANCELLATION OF THE SLASH PLATFORM REGISTRATION

We may cancel your SLASH platform registration in the circumstances mentioned in these Terms and Conditions.

We may cancel your SLASH platform registration if any of the warranties you have given in clause 4 are incorrect or if we suspect fraud or other inappropriate use of the SLASH platform.

We may cancel your SLASH platform registration.

if you breach any other provision of these Terms and Conditions or any provision of the SLASH website terms and conditions, a copy of which can be found here: (www.theslashapp.com/terms-of-service) and, in the case of a breach capable of being remedied, you do not remedy the breach within twenty-one (21) days of our requesting you to remedy the reach.

10. PERSONAL INFORMATION

We respect your personal information and take appropriate steps to use it only as set out in these terms and to keep it safe. All personal data is processed by us and retained in accordance with our Privacy Policy, when contacting merchants through The Slash App Messenger you wave your rights in giving out your email address as part of the messenger chat with Merchants and Events.

We will pass on personal information to any other service provider we use to supply the SLASH platform and related services, such as the company that hosts our cloud-based computing activities. Where we pass your data to such a third party, we will ensure that the third party is subject to an agreement that ensures the correct processing of your data both in accordance with these terms, the data protection legislation, and our Privacy Policy. Where you have asked us to pass on personal information to a third party, we may also pass your personal information to that third party.

11. CONTRACTS (RIGHTS OF 3RD PARTIES ACT 1999)

A third party shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of this Agreement.

12. WHOLE AGREEMENT AND REPRESENTATIONS

These Terms and Conditions set out the entire agreement between us relating to the SLASH App registration and use of the SLASH APP platform.

This Agreement supersedes all previous written or other documents or agreements (written or oral) relating to the subject matter of this Agreement, including, without limitation, all other information on our website regarding the SLASH platform. You acknowledge that in entering into this Agreement, you have not relied upon any representations other than those reduced to writing in these Terms and Conditions. The provisions of this clause 11 shall not apply to any fraudulent misrepresentation.

Notwithstanding the above, your use of our website at www.slash.com is governed by the SLASH website terms and conditions.

13. MISCELLANEOUS

In the event of any conflict between these Terms and Conditions and any web page linked to by these Terms and Conditions, the provisions of these Terms and Conditions shall prevail.

We may assign the whole of this Agreement as we in our discretion see fit.

We may sub-contract any of our rights and obligations under this Agreement as we in our discretion see fit.

Our failure at any time to enforce a provision of this Agreement shall not be deemed a waiver of such provision or of any other provision of this Agreement or of our right thereafter to enforce that or any other provision of this Agreement.

The formation, construction, performance, validity, and all aspects of these Terms and Conditions and the Agreement shall be governed by Thailand Law, and each of us hereby submits to the non-exclusive jurisdiction of the Thailand courts.
